Steps in the Khula Procedure

  1. Filing a Petition:
    • The process begins with the wife filing a suit for Khula in the Family Court. The petition must include valid grounds for seeking Khula, such as cruelty, non-maintenance, incompatibility, or any other justifiable reasons.
  2. Notice to the Husband:
    • Upon receiving the petition, the Family Court issues a notice to the husband, requiring his appearance before the court on a specified date.
  3. Reconciliation Attempts:
    • The court may attempt to reconcile the parties, typically through mediation. This step is aimed at resolving differences and potentially saving the marriage. If reconciliation fails, the court proceeds with the case.
  4. Evidence and Hearings:
    • Both parties present their arguments and evidence. The wife must substantiate her claims with relevant proof, and the husband has the opportunity to contest the petition.
  5. Decree of Khula:
    • If the court is satisfied with the wife’s grounds for Khula and reconciliation efforts prove unsuccessful, it grants a decree of Khula. The wife may be required to return the dower or any agreed-upon compensation to the husband.
  6. Registration of Divorce:
    • The court’s decree is then sent to the concerned Union Council for registration. The Union Council issues a formal divorce certificate, completing the process.

Legal Provisions and Implications

  • Mahr (Dower): One of the essential elements in the Khula process is the return of mahr. The wife may return the entire mahr or a part of it, depending on the court’s decision or mutual agreement.
  • Custody of Children: Post-divorce, the custody of children is determined based on their welfare. Typically, mothers are granted custody of young children, while fathers may retain visitation rights.
  • Maintenance: The court may order the husband to provide maintenance to the wife and children, depending on the circumstances of the case.
  • Appeal: Either party can appeal against the Family Court’s decision in the High Court if they are dissatisfied with the verdict.
